Terms of Service

Welcome to Donbar! These Terms of Service (“Terms”) govern your access to the website https://www.donbar.org/ and the services provided by Trevor Tech (“Donbar”, “we”, “us”, or the “Company”).

1. The Service

Donbar provides an email marketing platform. Paddle acts as our Merchant of Record for all transactions and is the legal seller of the Services. By purchasing a subscription or credits, you agree to be bound by Paddle's terms and conditions in addition to these Terms.

2. Eligibility and Account

  • Age: You must be at least 18 years old to use our Services.

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials (managed via PropelAuth) and for all activities that occur under your account.

  • Accuracy: You must provide accurate and complete information when creating an account.

3. Usage Credits and Subscriptions

  • Credits: Usage credits are valid for twelve (12) months from the date of purchase. Unused credits expire after this period and are non-refundable.

  • Subscriptions: Subscriptions renew automatically unless canceled through your account dashboard or via Paddle.

  • Pricing: We reserve the right to change our pricing at any time. Any price changes will be posted on the Site or communicated via email.

4. Acceptable Use and Anti-Spam Policy

You agree to use Donbar in compliance with all applicable laws, including the CAN-SPAM Act, CASL, and GDPR.

  • Consent: You may only send emails to recipients who have given you explicit "opt-in" consent to receive communications from you.

  • Prohibited Content: You may not use Donbar to send content that is illegal, harmful, threatening, abusive, harassing, defamatory, or contains malware.

  • Sensitive Information: You are prohibited from using Donbar to collect or store sensitive personal information (e.g., social security numbers, health information, or credit card details).

  • Unsubscribe Link: Every email sent through Donbar must include a clear, functional "unsubscribe" link.

5. Intellectual Property and Content

  • Your Content: You retain ownership of all content, email lists, and data you upload to the platform ("User Content"). You grant Donbar a limited license to host, process, and display your User Content solely to provide the Service to you.

  • AI and Service Improvement: To improve the platform, Donbar reserves the right to use de-identified or aggregated data (such as email templates, design structures, and metadata) to train our internal algorithms and artificial intelligence models. This is done to enhance features for all users and does not involve selling your raw data to third parties.

  • Donbar IP: The Site, platform, logos, and software are the intellectual property of Donbar and are protected by copyright and trademark laws.

6. Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms, especially our Anti-Spam Policy. In the event of termination for cause, you will not be entitled to a refund for any unused credits or subscription time.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DONBAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Governing Law and Dispute Resolution

In the event of any dispute, the parties hereto agree to first contact the other party and attempt in good faith to resolve the dispute informally. These Terms are governed by the laws of the State of Israel. Any disputes arising from these Terms that cannot be resolved informally shall be resolved in the competent courts of the Jerusalem District.
